PeaceHealth Southwest OFNHP Acute Care Professionals
 

As part of our commitment to keeping caregivers informed, we want to share an update regarding an unfair labor practice charge filed by the Oregon Federation of Nurses and Healthcare Professionals (OFNHP) with the National Labor Relations Board (NLRB) concerning health insurance for members of the PeaceHealth Southwest OFNHP Acute Care and Home and Community Professionals Bargaining Units.

You may have recently seen misinformation regarding this charge that indicates that you will soon be receiving reimbursements for premiums, deductibles or other out-of-pocket healthcare costs. We want to ensure you have the most accurate and up-to-date information about the status of this matter.

At this time, the National Labor Relations Board has not made a ruling on the complaint. As a result, no reimbursements have been ordered or approved.

On July 22, the regional office of the NLRB asked PeaceHealth to provide additional information as part of its review of the charge filed by OFNHP. PeaceHealth is fully participating in the process and has provided, and will continue to provide information requested by the NLRB’s regional office.

The NLRB’s processes include several steps before any final determination is made:

• The regional office of the NLRB investigates charges filed with it, in this case the charge filed by the OFNHP.
• The regional office of the NLRB determines if the evidence presented in the investigation warrants going to a hearing before an administrative law judge (ALJ).  If it decides this, it will issue a “complaint” and schedule a hearing. The regional office of the NLRB is currently indicating that it has preliminarily decided to do this but is continuing to investigate.
• If the matter goes to a hearing, an ALJ (independent from the regional office) will hear evidence from both sides and issue an actual decision.
• Both parties will then have the ability to file “exceptions” (that is, an appeal) of the ALJ’s decision with the actual National Labor Relations Board, which will issue its own decision.
• Both parties will then have the ability to file “petitions for review” (that is, a further appeal) to the federal appellate courts.

As you might expect, these legal processes can take several years to conclude.

We recognize that questions may arise when information is shared about ongoing complex legal or regulatory matters. Our goal is to ensure you have access to complete and accurate information as the process moves forward. We will continue to provide updates as appropriate and as new information becomes available.

On Aug. 10 and 12, PeaceHealth Southwest Medical Center and Oregon Federation of Nurses and Healthcare Professionals (OFNHP) resumed negotiations on a new contract for PeaceHealth Southwest acute care professionals in collaborative and professional bargaining sessions.

PeaceHealth appreciated the respectful and productive discussion and OFNHP’s continued engagement. Multiple proposals were exchanged. We reached a tentative agreement on the topic of job vacancies, and PeaceHealth presented the union with a Memorandum of Understanding related to the market increases needed for dieticians. These increases would satisfy year one wages in the collective bargaining agreement for dieticians.

PeaceHealth appreciated the respectful and productive discussion and OFNHP’s continued engagement. The conversation was open and collaborative, and progress was made.

During the session, PeaceHealth provided several proposals. We reached one new tentative agreement on health and safety. This brings the total to 11 tentative agreements to date, including:
