Exemptions to be granted to diabetic drivers using insulin Posted 12/18/2003 Truck and bus drivers using insulin to control diabetes can now apply for permission to operate across state lines under the new exemption program from the Federal Motor Carriers Safety Administration (FMCSA). The agency began accepting application in late September from diabetic drivers who have at least three years of safe commercial motor vehicle (CMV) driving experience while using insulin. Since 1970, the Federal Motor Carrier Safety Regulations have prohibited insulin-using diabetic drivers from operating in interstate commerce. At the time, studies indicated that diabetic drivers had a higher accident rate than the general population. In 1998, however, Congress asked the FMCSA to determine if an exemptions program could be safely developed. After several years of study, the agency’s answer was affirmative. The exemption program is “a creative approach” that will “enable an additional group of skilled professionals to keep freight moving in America while we keep a sharp eye on safety,” U.S. Transportation Secretary Norman Y. Mineta said. Exemption must be renewed at least every two years, and the FMCSA has the authority to revoke exemptions at any time. Under federal law, the agency may grant an exemption only if it is likely to achieve a level of safety that is equivalent or greater than the level that would be achieved without the exemption. “FMCSA believes that thorough screening of exemption applicants and periodic monitoring of their safety performance is the most practical way to ensure safety on the nation’s highways,” FMCSA Administrator Annette M. Sandberg said. Like the exemption program for drivers with vision problems, the FMCSA must publish a notice in the Federal Register before granting an exemption, identifying the applicant and the provisions from which they will be exempt, the effective period for exemption, and the terms and conditions of the exemption. The FMSCA diabetes exemption process has three components. First, qualified applicant will be identified, based on their driving and medical histories. Next, guidelines will be provided to those granted exceptions, to instruct them in managing and monitoring their diabetes. Finally, drivers will be monitored through medical examinations, glucose measures, and reports of severe hypoglycemia and accidents. The procedures for applying for an exemption are in 46 CFR.
